The depth of the criminality at the District of Tofino is exemplified by three different crimes against the English family all intended to destroy their business.

The first major crime regarding water billing is historic and is not regarded as related to the later BCIMC conspiracy but illustrates why British Columbia is a dangerous place to do business.

What the reader needs to understand is that all the pension funds of the District employees, including the Administrator, the engineer and the public works employees are managed by BCIMC which is intimately connected to all the public service unions in British Columbia and many such unions elsewhere in Canada so BCIMC is in a position to exert its influence over these people and punish and reward them as it deems fit. 

Fraudulent Water Billing By Tofino Public Servants 

In about 1997, Mr. English, finally had enough of ever increasing municipal water bills supplying water poisoned with chlorine, especially since the campground originally had its own water line coming from a creek on Meares Island and when the municipality put in its own water system they deceitfully convinced him to switch from his own system to the municipal system telling him their water would be free.

Instead, it was only free for the first year then they started billing him monthly and the bills got higher every year.

So, he drilled for water on his land, found an underground water source and built his own new onsite water system to service the campground and recreational vehicle park. 

He notified the District that he had his own water and that he was no longer using their water.

However, the crooked Tofino public servants continued to sent him a fraudulent water bill claiming as much as $2,000 per month in water use even though the lines were physically cut off.  

Crooked Tofino public servants claimed that their meter showed he was using lots of water.  

Mr. English had photos showing the lines were severed and he had documents proving the date when this was done and he sent these to Tofino and demanded that Tofino take the water meter to a qualified inspector to find out why it was not working properly.

Knowing they would be caught in fraudulent billing scheme and facing a jail term, the crooked public servants at Tofino officials sent in their workers and removed the water meter so it could not be used as evidence against them but they still demanded payment for the water they had fraudulently billed earlier and forced Mr. English to pay this by adding it to the property tax bill.

According to Jack English, when BCIMC embarked on its plan to take over his family resort it contacted Mayor John Fraser and Administrator, Braden Smith, and who hatched a diabolical plan that, according to  inside sources, was referred to as the "The Get Jack By - Law" which imposed "Development Cost Charges" (DCC) on each of the campsites and RV park site that were "160 times more" than those charged to other campgrounds and RV parks in the municipality.

The total bill was about $5.3 million and would have bankrupted the English family business.

The charges were allegedly for a sewer and water system but that was put in place over 40 years before Mayor, John Fraser and Administrator, Braden Smith occupied their positions at Tofino.

The imposition of the charges was completely illegal because the property was not part of the municipality when the water and sewer services were connected, DCC's were not authorized under the Municipal Act at the time and all property was grandfathered in when it was later incorporated into the municipality. 

This DCC issue was used by BCIMC in Court to argue that the English family property

have a low value, the business was not viable and that the English family had no way to pay our debt and no chance of redemption of our property. In retrospect, it now appears probable that Tofino officials were co-ordinating their efforts directly with the opposing party in the litigation and its lawyer, Steve Wilson, who was subsequently rewarded by BCIMC when he was hired by the Government to work as a court Master earning $250,000 per year.

The astute observer realizes immediately that it was very probably BCIMC insiders who crafted the by law because Mayor Fraser and his side kick, Administrator Braden Smith, are not well known for their intelligence.

Generally, there are very few Municipalities in British Columbia that charge DCC's on campgrounds.   Mr. English conducted a search and found that only ONE Municipality in BC charged DCC's on campsites and that was the City of Kelowna which charged only $50 per campsite while the District of Tofino was conspiring to put the English family out of business by charging $8,500 per campsite.

The fact that the charges were 160 times those charged to anyone else receiving similar services proved they were part of a criminally malicious attempt to bankrupt the English’s family campground and supports the overall theory that the intent was to make the property worthless in order to assist BCIMC to steal it for a tiny fraction of its actual value because no one in their right mind would put an offer in on a property facing those kinds of charges in addition to the other problems the Mayor and his Administrator had in mind - like cutting off the sewer service which is discussed below.

Mr. English appealed to people in the Provincial Ministry of Municipal Affairs in Victoria who oversaw local municipalities and they agreed the by-law was totally illegal and they told Mayor Fraser and Administrator Braden Smith to cancel it.

According to Mr. English, since about 1985, the English family's campground and recreational vehicle park, serving about 600 sites, had been connected to District of Tofino's sanitary sewer system through a gravity flow connection to the municipal lift station located nearby and to the District of Tofino municipal water system.  Mr. English and later, he and his children, ran the campground since 1984.

In 2010, crooked public servants at Tofino advised Mr. English that it intended to carry out some work at the gravity flow lift station that led to the English family campground and recreational vehicle park. This was located on the piece of property on the water side of highway and was not the same piece of property where BC Hydro had destroyed the access bridge in August, 2010.

The Tofino Administrator, Braden Smith, and the Tofino Municipal Engineer, John Motherwell, both gave assurances to Mr. English and his engineer, Mirek Demidow, that the sewer service would not be cut off.

Mr. English and his family were preparing to re-open the campground and RV park so they could re-establish their income flow and repay or re-finance their mortgage.

Everything was ready to go, but the criminal public servants at Tofino had different plans.

Despite their previous advice, the crooked public servants at Tofino had cut off the sewer service to the English family campground and recreational vehicle park and then refused to re-connect it.

The Tofino workers had actually blocked the sewer by pouring concrete into the sewer pipe.

This was done illegally, maliciously, and with the clear intent of driving the English family out of business.

IT DOES APPEAR REWARDS WERE PAID TO THE WICKED

The available facts suggest that BCIMC paid rewards to their faithful agents in their service at the District of Tofino who assisted BCIMC destroy the English Family’s business and assist snd deliver it to BCIMC at fire sale prices. 

Tofino Mayor, John Fraser, was rewarded with a position in Sotheby’s Realty Canada which was recently purchased by BCIMC. 

And, Tofino Administrator, Braden Smith, got a high paying job as the Chief Planner for the City of Winnipeg where BCIMC also does business. Mr. Braden Smith looks a little worried and so he should because, if he was party to the criminal conspiracy as it appears he was, then he faces career termination and a long jail term. 

Linda Pettinger, the real estate agent used by the Mission Creek Mortgage Ltd appeared to have rigged the judicial sale by making sure no one put a bid on the except BCIMC subsidiary Parkbridge and a suspected Hell’s Angel’s company from Coombs which was just slightly less.

It is a strange and odd coincidence that the Hell’s Angels were also involved with BCIMC at the Pickton Pig Farm massacres of mainly drug addicted First Nations women which explains why the local First Nations community wanted nothing to do with BCIMC.

More Dirt on Fraser and Smith

According to a  former Tofino Councillor, Administrator Braden Smith perjured himself while giving sworn testimony in BC Supreme Court proceedings in Victoria where Yew Wood Developments, were suing Smith and the District  of Tofino for malfeasance and fraud for his illegal shutting down of their project.

Yew Wood Developments lawyers, Crease Harman, in Victoria, were recalling Smith to be cross-examined about his alleged perjury and fabrication of evidence. 

Instead, Smith fled to Germany and failed to appear.

Smith allegedly called Mayor John Fraser from Germany and told him that if he was going to be convicted of these charges he would take Fraser down with him.  Fraser immediately called the District's Lawyers and ordered them to settle the case with Yew Wood for over $1 Million dollars so that Smith would not be charged
and possibly go to jail.

All of the foregoing is top secret and subject to a non-disclosure agreement that the lawyers for the District of Tofino crafted and got everyone to sign so the taxpayers in Tofino would not know why their funds were paid out and so Mayor Fraser and Administrator Smith would escape probable criminal prosecution and possible long term jail sentence if convicted.

On Wednesday, August 10, 2016 we contacted former Mayor John Fraser and former Administrator Braden Smith to get their side of the story.

Then on Friday August 12, 2016 we contacted the present Mayor, Councillors and Administrator of the District of Tofino to get their side of the story.  

We never got a reply from John Fraser and Braden Smith but on the very day we sent our email to the Mayor Councillors and Administrator of Tofino we got a reply that does not deny anything posted here but does not admit it either.

The Administrator refused to comment because there is litigation which is a normal response, we suppose, but not a good sign because it is more cover up of crimes by public servants who should be prosecuted and not protected.

The "reign of terror" by British Columbia Government Agencies against the English family of Tofino and other tenants on the Pacfic Rim Resort property continued today when, on instructions of Parkbridge lawyer, Brianna Hardwick, of Kelowna, (shown in photo on left) John  Bradshaw, who operates Comox Valley Bailiffs Ltd., attempted to remove several legal tenants from the property, including Jack English and his family, without complying with the mandatory provisions of the Residential Tenancy Act of British Columbia that require that the landlord serve proper notice on legitimate tenants whom it intends to evict and which gives the tenant the right to dispute a wrongful eviction.

Andrew Blair is the President and CEO of Parkbridge the company that is the legal beneficiary of the criminal conspiracy against the English family and he is considered a suspect in the conspiracy although the Editors believe that the masterminds behind the criminal conspiracy would likely have hidden some their plans from Blair who is a "puppet president" of Parkbridge a wholly owned subsidiary of BCIMC.  Blair may be asked to give evidence against BCIMC CEO, Doug Pearce, and CBRE Vice President, Mike Nissley, as the case proceeds.

Blair started his career as a lawyer in one of Canada’s pre-eminent commercial legal gangs a.k.a. law firm, so he should know that tenants have rights in Canada and cannot be evicted for no good reason. 

According to his online biography, Blair currently resides in Calgary with his wife Victoria and their young daughter, Alexandra.  Andrew enjoys a number of sports and activities including wakeboarding, canoeing and mountain biking in the summer and skiing and snowboarding in the winter.

In the Editors opinion, Blair, as CEO of Parkbridge, is in a position similar to that of the driver of the getaway car at a bank robbery because Parkbridge is the vehicle that was selected to carry "the loot" i./e. the Pacific Rim Resort Property, away from the owners after the clever orchestration of a criminal conspiracy.

 The bailiff, John Bradshaw, with Comox Valley Baillffs Ltd., has given the English Family 24 hours to get off the property and enlisted the RMCP as his agents.

Jack English,his family and the other tenants on the land were never given "the appropriate Notice to End Tenancy form available from any Residential Tenancy Branch Office or Government Agent's Office. 
  
The law in British Columbia specifically states that 

... no order of a court in a proceeding involving a foreclosure, an estate or a matrimonial dispute or another proceeding that affects possession of a rental unit is enforceable against a tenant of the rental unit unless the tenant was a party to the proceeding. (See Residential Tenancy Act section 94)

So why are government licenced lawyer, Brianna Hardwick, and government licenced bailiff, John Bradshaw, deliberately breaking section 94 of the Residential Tenancy Act to remove tenants who were not party to the proceedings which granted the order of possession to Parkbridge?  Are lawyers and bailiffs above the law?  Well, the truth is that, in British Columbia, government lawyers, like Hardwick, and agents like Bradshaw, regularly break the law and are never punished.     

The brazen criminality used against the English Family of Tofino as part of a court process that benefits government agencies is a classic example of why British Columbia is not a safe place to invest.

So, late today, Suzanne Anton, the Attorney General and Minister of Justice for British Columbia (shown in photo on right) was asked to do her job and take control of the obviously lawless government agencies that are hell bent to destroy an innocent family and other innocent tenants.

Under the section 2 of the Attorney General Act, the Attorney General

(b) must see that the administration of public affairs is in accordance with law,

 

(f) must advise the heads of the ministries of the government on all matters of law connected with the ministries,

 

(I) has the regulation and conduct of all litigation for or against the government or a ministry in respect of any subjects within the authority or jurisdiction of the legislature,

 

Jack English and the Editors of this blog have asked Suzanne Anton to do her job and instruct Kelowna lawyer, Brianna Hardwick, who is handling the government litigation that is evicting several tenants at the Pacifc Rim Resort property, to respect section 94 of the Residential Tenancy Act. 

 

Jack English has asked Suzanne Anton to contact government licenced bailiff, John Bradshaw, and remind him of his obligation to respect the rights of tenants conferred by section 94 of the Residential Tenancy Act.

Doug Pearce has been with BCIMC since 1988 when it was set up as an agent of the Government of British Columbia to manage civil service pension funds.

Terrorism Used Against the English Family

The Editors believe the decision of Doug Pearce to resign is directly linked to this blog and his connections to the criminal conspiracy involving BCIMC subsidiary Parkbridge Lifestyle Communities Ltd., of Calgary, as beneficiary of the conspiracy to take over the property of the Pacific Rim Resort owned by the English family of Tofino using terrorist tactics that included death threats, multiple acts of vandalism, arson, attempted murder and other crimes.

At this time, that Editors have no hard evidence that Doug Pearce was directly involved in the approval of these terrorist tactics but the circumstantial evidence is building and, whether or not he approved of the use of the terrorist tactics, he is responsible for the creation of the corporate culture that allowed these events to take place. 

There is powerful undisputable evidence that the Pacific Rim Resort property and the English family were the targets of a series of attacks that can best be described as terrorism.  

There is also undisputed evidence that BCIMC wholly owned subsidiary Parkbridge was a beneficiary of that terrorism. 

Applying the forensic principle, that he who profits most from a crime is the one most likely to have committed it, the logical conclusion is that insiders or agents connected to BCIMC were the masterminds behind the crimes of terrorism carried out against the English family and the Pacific Rim Resort Property.

In a court hearing now scheduled for October 7, 2013, in Kelowna, British Columbia, Jack English will be asking a justice of the Supreme Court of British Columbia to order BCIMC, the Government of British Columbia and all connected parties to produce copies of all documents and records, electronic, print of other form, that make any mention of him and the property.  That disclosure is expected to disclose the Doug Pearce as CEO of BCIMC was fully informed of and approved of the Parkbridge acquisition.

Justices of the Supreme Court of British Columbia are paid by Ottawa and their pension funds are not managed by BCIMC.  However, court administrative staff are paid by the Government of British Columbia and their pensions are managed by BCIMC which may explain why certain court administrative staff appear to be bending and breaking the law in order to destroy Jack English and his ability to fight the case.  

After The Failed Murder Attempt There Is More Violence Against Jack English And Family

There was more violence and more intimidation aimed at the English family and their property near Tofino.  

The attack estimated to have occurred at between midnight and 5 am on the night of August 22, 2013 when criminals smashed open doors and stole contents (tools, equipment etc) a from wash house and a pump house.  They also broke into a trailer on the property. 

The message was clear.

"Move off the property or we will destroy you"  

Did the BC Government order a murder? 

It is patently clear that the criminals are worried. The murder attempted over the night of August 16 and 17 had failed and Jack English and his family have not been frightened off the property although he and his son were nearly killed.

Jack English has now filed legal documents seeking to set aside the disputed court order selling his family property to Calgary based Parkbridge Lifestyle Communities Inc. at artificially reduced fire sale prices.  Parkbridge is the wholly owned subsidiary of British Columbia Investment Management Corporation. (BCIMC) with its million dollar a year salary CEO Doug Pearce. 

Jack English claims the drastically reduced sale sale price was the result of a fraudulent criminal conspiracy against the process of the court.

BCIMC and its CEO Doug Pearce have hired one of Vancouver's top legal gangs, Lawson Lundell,  who were previously involved in one of the leading legal-judicial scam's in that City where the court's have developed an notorious international reputation for corruption.

False Advertising By BC Government

It will be a tough fight because the Government of British Columbia controls the administration of the courts and it is expected BCIMC will use its considerable influence to insure that a government friendly judge is appointed to the case.

This has been a common practice in British Columbia where even a prominent judge complained about the system of select judges who favour the government in key cases.

More violent attacks on Jack English and his family are expected.

The Ungrateful Premier Christy Clark

The RCMP have been unable to stop the violence and Premier Christy Clark remains in hiding refusing to comment or meet with her former supporter Jack English who had put up multiple billboard type signs supporting her in the last election.

She has also refused to support the request for a police investigation into what appears to have been a clear attempt to benefit her government and, probably, government insiders involved in the Treaty Negotiation process.

Reward Increased to $50,000: Insiders begin to sweat and Court Date Is Set

Jack English has raised the stakes in his battle against the criminal conspirators and their suspected agents inside BC Hydro, British Columbia Investment Management Corporation (BCIMC) and Parkbridge Lifestyle Communities Inc. who conspired to carry out a hostile takeover of his family property through terrorism, firebombing, death threats and other criminal activities by increasing the cash reward from $25,000 to $50,000 for information leading to the arrest, prosecution and conviction of those who were behind the crimes carried out.

At the same time, lawyers for Jack English and his family have filed legal documents in the Supreme Court of British Columbia asking the court to revoke the court order for sale of the property to Parkbridge, a wholly owned subsidiary of BCIMC, that was made by Justice Betton in February, 2013 on the basis that the order was obtained as part of a criminal conspiracy.

The general rule of law is that no court will allow its process to be used to assist to carry out a crime or a criminal conspiracy.

A criminal conspiracy is an established fact

Legal scholars advise that Jack English has an excellent case because the evidence of a criminal conspiracy is overwhelming and cannot be refuted even if the actual criminals remain unidentified at this time.

In order to assist the court identify the criminals, the lawyers are asking for court  orders compelling full disclosure of all documents including documents that are normally confidential such as communications among the various lawyers who are thought to have been part of the obvious criminal conspiracy.  

Under Canadian law, solicitor client privilege does not protect lawyers involved in a criminal conspiracy.

Jack English and his family are hoping the increased reward will assist to rapidly identify the personal criminals involved.  The case has been reported to the RCMP who have been asked to carry out a full investigation.

The first court hearing is set for the week of September 9, 2013, at the courthouse in Kelowna, British Columbia.  The court house telephone number is 250-470-6900.

The case has wide ranging implications for the BCIMC, Parkbridge, BC Hydro, the legal profession and the Government of British Columbia Premier Christy Clark (shown in photo on left) who has, in the past,  attacked the power of the public sector unions and the problems in the province's courts. 

It is expected that the case will give the Premier Clark the leverage to bring in the necessary legislation to re-assert public control over both the province`s public sector unions and the province`s legal profession that has earned an international reputation for corruption, money laundering and other criminal activities.

The British Columbia and other Canadian mainstream media have, to date, refused to publish the story because they are controlled by the public sector union movement.

Cowardly BCIMC and its lawyer, Robert des Trois Maison, Go into Hiding along with David Lebeter of BC Hydro

On Sunday July 28, 2013, (See blog post below) the Editors of this blog published the letter of BCIMC lawyer, Robert des Trois  Maison, (shown in photo on left) where he complained that the comments we had published about his clients, Doug Pearce and BCIMC, were "false and defamatory".

On July 28, 2013, the Editors contacted Robert des Trois  Maisons and asked him "please let us know the specific statements you complain of and we will remedy the matter".

On July 30 2013, a follow up email was sent to Robert des Trois Maison asking him if he was going to respond.

Ten days have elapsed and the Editors have heard nothing from Robert des Trois Maison so the logical conclusion is that the accusations made about BCIMC and Doug Pearce are true.

In the next few weeks, the Editors expect to post some block buster revelations about BCIMC and a certain a certain government Ministry that is going to shake the corrupt British Columbia civil service to its foundations and will explain to the readers what was really behind the campaign of terrorism against English Family and their property.

Did agents of British Columbia Investment Management Corporation (BCIMC) and Parkbridge THREATEN to MURDER a Nova Scotia mortgagte broker?

When Jack English could not find financing in British Columbia to pay out the Mission Creek mortgage on his property at Pacific Rim resort he reached out to contacts on the other side of Canada in the province of Nova Scotia and found a mortgage broker who offered to try to place his business outside the province among lenders in eastern Canada.  

Information was circulated among various lenders and there was a high interest because of the obvious value of the property and its ability to generate cash flow to pay back the debt. 

Then, on November 1, 2011 the mortgage broker reported: "I have received a couple of threatening calls from a blocked caller telling me to back off this project"

Again, on November 4, 2011, the mortgage broker reported "They called on Tuesday around 3 pm. The number was blocked. The gentleman told me to stop sending the package out for John English or I would regret it."

Finally, the mortgage broker decided that it would be safer for her if she stopped trying to find financing for Jack English, so she dropped the project for fear of her life.

Who would commit the crime of threatening the mortgage broker? 

It is reasonable and logical to conclude that the person who committed the crime was working for the parties who were trying to buy the property at below market values and those parties were BCIMC and its subsidiary, Parkbridge.

This is the logical or rational probability.

It is the Editors opinion that BCIMC, its subsidiary Parkbridge or one of their agents broke the Criminal Code of Canada and threatened to harm a mortgage broker to dissuade her from doing her job of finding mortgage funds for Jack English and his family

Until the criminals who attacked Jack English are put in jail, residents of British Columbia and investors in British Columbia have good reason to fear that they and their property will be similarly stolen from them.

Editors Note: On Friday afternoon July 26, 2013.  One of the persons connected to the publication of this blog received an intimidating telephone call from a woman who identified herself as Constable Aderichin of the Victoria City Police.  Constable Aderichin stated she wanted to discuss the blog.    She was informed that the blog was an expression of political opinion and the conversation was ended.  

The expression of political opinion is a right guaranteed by Canada's Charter of Rights and Freedoms, Canada's Bill of Rights, the common law and International Treaties.

So, what was this Victoria Constable Aderichin up to and why was she attempting to intimidate the Editors / Publishers of this political blog that is asking questions about crimes that appear to be committed by agents of the government?

Readers will be interested to know that the Victoria City Police pension funds are invested with BCIMC.  It is logical to conclude her pension funds managers asked her to intimidate the publishers of this blog.

It is now patently obvious that the Government of BC, BCIMC, BC Hydro or their agents are attempting to use the police to suppress freedom of speech, freedom of the press and freedom of political expression in Canada.   The Victoria City Police have been used for similar purposes in the past and several years ago initiated a malicious prosecution against a prominent whistleblower.

The logical conclusion is that the allegations on this blog are absolutely correct and that crimes were carried out by agents of BCIMC and BC Hydro and the BC Government and they are terrified that the truth is being told in a free and open way.
